1. AGREEMENT TO TERMS
By accessing or using any part of the Electric Beets Services — including browsing our website, creating an account, placing an order online, or purchasing products in person at any Electric Beets grab-and-go location — you enter into a binding legal agreement with Electric Beets, LLC and agree to comply with and be bound by these Terms in their entirety.
If you do not agree to these Terms, you must discontinue use of the Site and Services immediately. These Terms apply to all visitors, customers, registered users, and all others who access or use the Services.
NOTICE: These Terms contain a binding arbitration clause and a class action waiver in Section 15. Please read them carefully, as they affect your legal rights.
2. OUR SERVICES
Electric Beets is a plant-based grab-and-go food business dedicated to offering fresh, nutrient-dense, whole-food meals and snacks. Our Services include, without limitation: our website at www.electricbeets.com for information, online ordering, and account management; in-location grab-and-go food sales at all Electric Beets physical locations; pre-ordering, and scheduled pickup services; catering and bulk ordering services where available; our loyalty rewards program (if and when offered); and email, SMS, and other marketing communications you opt into.
We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice, and without liability to you or any third party. Menu items, ingredients, and availability may vary by location and are subject to change without notice.
3. ELIGIBILITY & USER ACCOUNTS
Age Requirement. You must be at least 18 years of age to create an account or place an order through the Site. By using the Services, you represent and warrant that you are 18 years of age or older and possess the legal authority to enter into this Agreement.
Account Registration. To access certain features of the Site - including online ordering, saved preferences, or rewards redemption - you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated at all times. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at hi@electricbeets.com of any unauthorized use of your account.
Account Termination. Electric Beets reserves the right, in its sole discretion, to suspend or terminate your account at any time for any reason, including but not limited to your violation of these Terms, suspected fraudulent activity, or any conduct that we determine is harmful to other customers, employees, or the integrity of our business.
4. ORDERS & PAYMENT
Order Acceptance. All orders placed through the Site or our ordering channels constitute an offer to purchase the selected items and are subject to acceptance by Electric Beets. We reserve the right to refuse or cancel any order at any time for any reason, including limitations on quantities available, errors in product or pricing information, or problems identified by our fraud detection systems.
Pricing. All prices are displayed in U.S. dollars and are subject to applicable sales tax, which will be calculated and displayed at checkout. Prices are subject to change without notice. In the event of a pricing error, Electric Beets reserves the right to cancel the affected order and issue a full refund.
Payment Methods. We accept major credit cards, debit cards, and other payment methods as displayed at checkout. Payment processing is handled by third-party payment processors. Your payment information is transmitted securely and is not stored on our servers. By submitting payment, you authorize Electric Beets to charge your selected payment method for the total order amount including applicable taxes and fees.
Pickup & Availability. Orders placed online for pickup are subject to product availability at your selected location at the time of pickup. While we strive to fulfill every order as placed, certain items may sell out prior to your pickup time. In such cases, we will make reasonable efforts to contact you and offer alternatives or a refund for the unavailable items.
5. REFUNDS & ORDER MODIFICATIONS
Cancellations. Because our products are freshly prepared, order cancellations may be subject to timing restrictions. Online orders may be cancelled for a full refund if the cancellation is requested within the window indicated at the time of purchase, prior to the scheduled preparation time. Orders that have already entered active preparation cannot be cancelled, and refunds will not be issued for cancellation requests received after preparation has begun.
Refund Policy. If you are dissatisfied with your order due to product quality, incorrect items, or a defect in preparation, please contact us within 24 hours of purchase at hi@electricbeets.com with your order details and a description of the issue. Electric Beets will review all claims in good faith and reserves the right to offer a replacement, store credit, or refund at our discretion. Refunds, if approved, will be applied to your original payment method within 5–10 business days, depending on your bank or financial institution. We reserve the right to deny refund requests that we determine, in our sole discretion, to be fraudulent, abusive, or outside the scope of our policy.
6. FOOD SAFETY, ALLERGENS & NUTRITIONAL INFORMATION
Allergen Disclosure. Electric Beets prepares plant-based foods that may contain or come into contact with common allergens, including but not limited to tree nuts, peanuts, soy, wheat/gluten, and sesame. While we take reasonable precautions to prevent cross-contact, our kitchen environments are not allergen-free. We cannot guarantee that any item is completely free of allergens. If you have a food allergy or dietary restriction, please consult with our staff before purchasing. Customers with severe allergies purchase and consume our products at their own risk.
Nutritional Information. Nutritional information provided on our Site or in-store is based on standard recipes and is intended for general informational purposes only. Actual nutritional values may vary based on ingredient availability, batch variation, and portion sizes. Electric Beets makes no warranty regarding the accuracy of nutritional data.
Freshness & Storage. Our products are made fresh and are intended for immediate or near-term consumption. We provide recommended consumption windows on our packaging. Electric Beets is not responsible for any adverse effects resulting from improper storage, handling, or consumption of products outside of the recommended timeframe after purchase.
7. REWARDS PROGRAM
Electric Beets may offer a customer loyalty and rewards program ("Rewards Program") from time to time. Participation in the Rewards Program is subject to separate program terms, which are incorporated into and made a part of these Terms by reference. In general, the following conditions apply: rewards points or credits have no cash value and are non-transferable, except as required by applicable law; points may not be earned on purchases made through unauthorized third-party platforms unless expressly stated; Electric Beets reserves the right to modify, suspend, or terminate the Rewards Program at any time with or without notice, which may result in forfeiture of accumulated points or credits; fraudulent use or abuse of the Rewards Program will result in immediate disqualification and potential account termination; and offers and promotions distributed through the Rewards Program may not be combined with other discounts unless explicitly permitted.
8. INTELLECTUAL PROPERTY
All content appearing on the Electric Beets Site and in our marketing materials - including but not limited to our name, logo, branding, taglines, photographs, illustrations, graphic designs, text, recipes, and menu descriptions (collectively, "Electric Beets Content") — is the exclusive property of Electric Beets, LLC and is protected by applicable U.S. and international copyright, trademark, trade dress, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site and its content for personal, non-commercial purposes only. You may not reproduce, copy, modify, or create derivative works from any Electric Beets Content without express written permission; sell, license, distribute, or commercially exploit any Electric Beets Content; remove or alter any copyright, trademark, or proprietary notices; or use any Electric Beets name, logo, or branding in a manner likely to cause confusion or suggest affiliation without written authorization. Any unauthorized use may violate copyright, trademark, and other applicable laws and may subject you to civil and criminal liability.
9. USER-GENERATED CONTENT
If you submit, post, or share any content through the Site, via email, or through social media in connection with Electric Beets - including reviews, photographs, comments, or testimonials ("User Content") - you grant Electric Beets a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, publish, display, distribute, and create derivative works from such User Content in any media format and for any purpose, including marketing and promotional purposes, without compensation or attribution to you.
You represent and warrant that you own or have the necessary rights to submit User Content and that such content does not violate the rights of any third party. You agree not to post content that is defamatory, obscene, fraudulent, harassing, threatening, or otherwise unlawful. Electric Beets reserves the right, in its sole discretion, to remove or refuse to publish any User Content for any reason, without notice.
10. THIRD-PARTY PLATFORMS & DELIVERY SERVICES
Electric Beets may partner with third-party delivery platforms (such as DoorDash, Uber Eats, Grubhub, or similar services) to facilitate delivery of our products. When you order through these platforms, your order is subject to their own terms of service and privacy policies, and Electric Beets is not responsible for any errors, delays, or service failures attributable to such third parties.
Our Site may also contain links to third-party websites. These links are provided for your convenience only. Electric Beets does not control, endorse, or assume responsibility for the content, policies, or practices of any third-party website. We encourage you to review the terms and privacy policies of any third-party site you visit.
11. PRIVACY
Our Privacy Policy, available at www.electricbeets.com/privacy, describes how Electric Beets collects, uses, stores, and discloses information about you in connection with your use of the Services. The Privacy Policy is incorporated into and forms a part of these Terms. By using the Services, you consent to the collection and use of your information as described in the Privacy Policy. If you opt into SMS or email marketing communications, you may unsubscribe at any time by following the opt-out instructions in any communication we send, or by contacting us at hi@electricbeets.com.
12. DISCLAIMER OF WARRANTIES
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES, INCLUDING ALL CONTENT, PRODUCTS, AND INFORMATION MADE AVAILABLE THROUGH THE SITE, ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. Electric Beets does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components; that the results of using the Services will meet your requirements; or that any information provided through the Site is accurate, complete, reliable, current, or error-free. Some jurisdictions do not allow the exclusion of implied warranties, and in such jurisdictions the foregoing exclusions may not fully apply.
13. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ELECTRIC BEETS, LLC AND ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SERVICES. In no event shall the total cumulative liability of Electric Beets to you for any and all claims exceed the greater of: (a) one hundred U.S. dollars ($100.00), or (b) the total amount paid by you to Electric Beets in the twelve (12) months immediately preceding the event giving rise to the claim.
14. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Electric Beets, LLC and its respective officers, directors, members, employees, agents, contractors, licensors, and successors from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of or access to the Services; your violation of any provision of these Terms; your violation of any applicable law, regulation, or third-party right; any User Content you submit or transmit through the Services; or any misrepresentation made by you in connection with the Services.
15. DISPUTE RESOLUTION & ARBITRATION
Informal Resolution First. Before initiating any formal dispute resolution proceeding, you agree to first contact Electric Beets in writing at hi@electricbeets.com with a brief description of the dispute and your contact information. The parties agree to attempt to resolve the dispute informally for at least thirty (30) days before either party initiates formal proceedings.
Binding Arbitration. If informal resolution does not result in a satisfactory resolution within 30 days, either party may elect to resolve the dispute through binding individual arbitration administered by a recognized national arbitration forum (such as the American Arbitration Association or JAMS) pursuant to its then-current consumer arbitration rules. The arbitrator shall have the authority to award the same remedies and relief that a court of competent jurisdiction could award. The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction.
Class Action Waiver. YOU AND ELECTRIC BEETS EACH WAIVE THE RIGHT TO PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS ONLY. Nothing in this Section limits either party's right to seek injunctive or equitable relief in a court of competent jurisdiction for matters involving intellectual property rights or unauthorized use of the Services.
16. GOVERNING LAW & JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. To the extent any dispute is not subject to arbitration under Section 15, you and Electric Beets agree to submit to the exclusive personal jurisdiction of the state and federal courts located in New York State. If you are using the Services from outside the United States, you do so at your own risk and are solely responsible for compliance with applicable local laws.
17. CHANGES TO THESE TERMS
Electric Beets reserves the right to update or modify these Terms at any time in its sole discretion. When we make material changes, we will update the "Last Updated" date at the bottom of this page and, where required by applicable law, provide additional notice. Your continued use of the Services following the posting of any revised Terms constitutes your acceptance of those changes.
